1. Who we are

SK Fuerte Capital offers on-ramp/off-ramp solutions, execution of spot orders as broker/agent, custody of client crypto and fiat assets, and transfers (on-chain and internal ledger).

We prioritize focus on security, traceability, and operational efficiency for high-net-worth individuals, corporations, residents and non-residents of El Salvador seeking professional, regulated digital asset services.

2. What is the SK Fuerte Capital Account

It is a segregated digital asset and fiat custody account of a transactional nature, owned by the User (Client / You), intended for the movement of resources for on/off-ramp operations, spot execution, custody, and transfers.

You add resources to the account through on-ramp (fiat to stablecoins/crypto) via banking/PSP partners, and these values are recorded in segregated custody (primarily via Fireblocks MPC-CMP vaults under our instruction control). Through this account, SK Fuerte Capital provides payment and digital asset services related to the deposit and withdrawal of resources, the execution or facilitation of payment instructions, including transfers, and the conversion between fiat and digital assets.

It is not a traditional bank deposit account and, unless otherwise expressly provided, does not yield interest or monetary correction. The SK Fuerte Capital Account is used by the client for on/off-ramp solutions, spot trading execution as agent, custody of crypto and fiat, and transfers (on-chain and internal ledger). Unlike a bank current account, it cannot be used for loans and does not issue checks.

3. Main services and functionalities

3.1. Funding the SK Fuerte Capital Account: deposit resources in fiat or stablecoins via on-ramp solutions. The deposited values are recorded in segregated custody. From the payment and execution instructions given by the user, SK Fuerte Capital routes spot orders to institutional liquidity providers (acting exclusively as agent), executes on/off-ramps, performs on-chain and internal ledger transfers, and registers the corresponding debits and credits in the client's segregated account.

3.2. Basic rules of use and movement of resources

The SK Fuerte Capital Account operates on a segregated custody basis: the holder may only perform operations if there is available balance in the account.

The USER may, through the SK Fuerte Capital Account, perform the following transactions and consultations:

  • On-ramp / Off-ramp solutions (fiat ↔ digital assets)
  • Execution of spot orders as broker/agent via liquidity providers
  • Custody of client cryptocurrency (hot/cold wallet solutions) and associated fiat balances
  • Transfers (on-chain to external wallets and internal ledger transfers)
  • Consult balance and extract in real time on the platform/digital channels

The exact list of functionalities may be updated and will always be informed on the Platform, so the USER must consult the current version before using the service. The resources held in the account are used for the above services, are in principle not remunerated, and must have a lawful origin.

3.3. Receipts and documents

Receipts of transactions performed and other documents related to account movements will be made available to the holder within the deadlines and forms defined by SK Fuerte Capital, through the platform and digital channels.

3.4. Nature of resources and asset protection

Pursuant to Article 19.f.2 of the Digital Asset Issuance Law (LEAD) and the corresponding provisions of the RPSAD, the resources held in the SK Fuerte Capital Account constitute segregated client patrimony that does not mingle with the patrimony of SK Fuerte Capital, does not respond directly or indirectly for any obligation of SK Fuerte Capital, and may not be subject to attachment, seizure, search and seizure or any other judicial constraint act due to debts of SK Fuerte Capital's responsibility. They do not form part of SK Fuerte Capital's assets for bankruptcy or judicial or extrajudicial liquidation purposes and may not be given as guarantee for debts assumed by SK Fuerte Capital.

4. Basic contracting rules

The account may be contracted by:

  • i. natural persons, over 18 years of age, with regular identification;
  • ii. legal entities, regularly incorporated, with a duly empowered legal representative.

Contracting is carried out digitally through the platform or other official channels of SK Fuerte Capital. The use of voice telephony channels for account opening is prohibited.

To open the account, the holder must:

  • i. complete the registration with true and complete information;
  • ii. submit documents for identity validation, fraud prevention and AML/CFT;
  • iii. accept the Terms and Conditions of Use and the Privacy Policy.

In the case of an account for an incapacitated person, the guardian or representative who will assist or represent them will also be identified and qualified.

Prior to the opening of the segregated custody account and to any change of holders or their representatives, SK Fuerte Capital will consult the applicable CNAD and UIF systems.

Approval of the registration, account opening and access to functionalities and limits are subject to SK Fuerte Capital's internal risk and compliance policies.

5. Basic rules of use and movement

The holder must adopt the following security measures when using the account and payment instruments:

  • never share passwords, tokens or authentication codes with third parties;
  • always check the recipient's name before confirming any on-ramp, off-ramp, transfer or execution;
  • keep devices protected and with updated systems;
  • be wary of unexpected contacts requesting personal data or transfers.

5.1 Conditions of movement and security

The SK Fuerte Capital Account operates on a segregated custody basis: you only perform operations if there is available balance.

SK Fuerte Capital may:

  • i. define minimum and maximum limits per transaction, per day and per period;
  • ii. apply specific limits for on/off-ramps, spot execution and transfers for security reasons;
  • iii. refuse, hold or block transactions with indications of fraud, inconsistency, irregularity or use incompatible with your profile.

The resources held in the account:

  • i. are used for on/off-ramp solutions, spot execution, custody and transfers;
  • ii. are in principle not remunerated;
  • iii. must have a lawful origin (you declare that you will not use the account for illicit purposes).

5.2 Procedures in case of loss, theft or robbery of credentials

If the holder suspects fraud, loss, theft or robbery of the device or access credentials, he/she must immediately take the following measures:

  • access the platform (if possible) and immediately change the password;
  • notify SK Fuerte Capital through the customer service channels to request blocking of the account and/or functionalities; and
  • file a police report, when applicable.

5.3 Situations of account and functionality blocking

SK Fuerte Capital may block the account or specific functionalities in the following situations, among others:

  • communication of loss, theft or robbery by the holder;
  • suspicion or confirmation of fraud, undue use or irregularity;
  • non-compliance with the Terms and Conditions of Use or applicable legislation;
  • pending cadastral update requested by SK Fuerte Capital for AML/CFT and fraud prevention purposes; and
  • determination by a competent authority.

6. Main risks

6.1. Security and fraud risks

Risks related to undue use of login, password, token or biometrics by third parties, especially in cases of:

  • i. sharing of credentials;
  • ii. scams by phone, messaging apps, social networks or fake links;
  • iii. installation of malicious software on cell phone/computer.

6.2. Risks of digital asset services

On-ramp/off-ramp, spot execution and on-chain transfers are instant or near-instant, which increases the risk of scams and erroneous sending of resources. Incorrect information (wrong wallet address, adulterated QR Code or incorrect recipient) may lead to sending to third parties without automatic reversal.

6.3. Operational risks

Temporary unavailability or slowness of the Platform, liquidity providers, banking/PSP rails or external systems may occur, as well as communication failures with telecommunications networks or internet providers.

6.4. Asset protection

Client assets held in the SK Fuerte Capital Account are fully segregated under Article 19.f.2 of the LEAD and RPSAD custody rules. They do not form part of SK Fuerte Capital's own assets and enjoy specific legal protection against the institution's creditors.

7. Fees and costs

SK Fuerte Capital may charge fees for the use of certain services, when applicable.

The complete and updated list of fees, containing the description of the service, the amount and the form of charging, is available for consultation on the SK Fuerte Capital platform, in the fees section, and on the SK Fuerte Capital institutional website. Before concluding any operation, the holder may consult whether there is an applicable fee and the respective amount.

8. Withdrawal of resources and account closure

8.1. Withdrawal of resources. The holder may request full withdrawal of the available balance at any time through off-ramp solutions and/or other means made available on the Platform. SK Fuerte Capital may offset matured debts (for example, due fees) with the account balance, as provided in the Terms and Conditions of Use.

8.2. Account closure by the holder. The holder may request account closure at any time, including by electronic means or through the same channel used for opening, if still available. SK Fuerte Capital will inform the holder of the closure date or the reasons that prevent closure within up to 30 calendar days. Prior to closure, any remaining balance must be transferred to the account indicated by the holder at SK Fuerte Capital or at another institution or, alternatively, at the holder's discretion, the resources must be made available for subsequent withdrawal.

SK Fuerte Capital will provide the holder with information on any products and services that remain active or that end together with the account.

8.3. Account closure by SK Fuerte Capital. SK Fuerte Capital must close the account in the following cases, among others:

  • verification of serious irregularities in the information provided by the holder, including situations of suspended, canceled or null identification;
  • provision of services by the holder that constitute digital asset services without due legal authorization or in disagreement with current regulation;
  • prolonged inactivity, according to the rules of the Terms and Conditions of Use;
  • non-compliance with the Terms and Conditions of Use and applicable legislation; and
  • determination by a competent authority.

When applicable, the holder will be notified about the closure and the necessary measures, including withdrawal of any remaining balance.

10. Cadastral update

The holder's identification and qualification information must be kept updated. The holder must inform SK Fuerte Capital of any change in his/her data, especially address, telephone numbers, e-mail, documents and economic activity information and, in the case of a legal entity, corporate and tax data. SK Fuerte Capital may request cadastral update and additional documents for validation of the information, and may restrict functionalities until regularization.

12. Important Notice

SK Fuerte Capital does not tolerate and does not allow the use of any of its services for illicit activities, fraud, money laundering, terrorist financing or acts of corruption.
